Pennsylvania Department of Education Drops Suit Against Agora Cyber Charter School

West Chester, PA – Retained as attorneys for Agora Cyber Charter School in Devon, PA, Lamb McErlane PC, announced today that the lawsuit and injunction against its client brought by the Pennsylvania Department of Education (PDE) in Commonwealth Court on April 29, 2009 was officially dropped on Friday morning, May 29, 2009.
The suit alleged Agora had without authorization entered into an outside management agreement with Cynwyd Group, LLC, a management company co-created by Dorothy June Brown, one of the school’s founders. The civil complaint further alleged the school had misused taxpayer dollars to benefit Ms. Brown.

Mr. Joel L. Frank, Managing Partner of Lamb McErlane, said “Agora is happy PDE decided to drop its hastily filed lawsuit after we had the opportunity to speak with them. We certainly would have preferred to have engaged in a dialogue prior to the institution of the now discontinued suit.” The suit was dropped after Agora’s attorneys noticed a series of depositions and served an extensive document production request.

“I am so pleased that the PDE dropped the suit so quickly. It’s been a challenging time for many people, and we are anxious to focus all of our attention back on our mission of helping ignite the minds of our students so they can reach their full potential” said Kathleen Suloff, acting-CEO of Agora.

Mr. Frank continued, “Should PDE take other measures to detrimentally impact Agora, those will likewise be vigorously and aggressively defended.” The Lamb McErlane attorneys representing Agora are Honorable William H. Lamb, Joel L. Frank, John J. Cunningham, IV and Scot R. Withers.
